    Who We Are

PlayTheory is an interactive music-theory learning app. PlayTheory is a brand of Excellence Online B.V., a private limited company registered in the Netherlands (the company details are listed below). In these Terms, "we" and "us" mean Excellence Online B.V. These Terms of Service ("Terms") apply to the PlayTheory website, web app and related services (together, the "Service"). By creating an account you agree to these Terms. Please read them; if you do not agree, do not use the Service.

    Eligibility

You must be at least 16 years old to create an account. If you are younger, you may only use the Service with the permission of a parent or legal guardian, who then agrees to these Terms on your behalf and is responsible for any paid plan.

    The Service

PlayTheory offers interactive lessons, exercises, ear training, practice games, an AI tutor, social features and progress tracking. You play along on the on-screen piano, your computer keyboard or a MIDI keyboard; some features can use your microphone to hear the notes you play (see the Privacy Policy). We keep improving the Service, so lessons and features may change. We will not remove the main features of a paid plan during a period you have already paid for.

    Your Account

Keep your login details secure and make sure the information you give us is correct. Your account is personal and may not be shared or sold. Tell us at playtheory@musiciangoods.com if you think someone else is using your account. You can delete your account at any time in Settings.

    Free Plan and Pro

The free plan lets you complete up to three lessons a day and use a limited number of AI-tutor messages a day. Pro removes the daily lesson limit and unlocks everything that Pro lists at the moment you buy it. Pro is sold as a monthly, quarterly or yearly subscription. The price shown before you pay is the total price, including VAT where it applies. Payments are processed by Stripe. If a plan starts with a free trial, the trial length is shown before you start and you can cancel before it ends without paying anything.

    Right of Withdrawal

If you are a consumer, you may withdraw from a paid subscription within 14 days after concluding it, without giving a reason. When you start a paid plan we ask you to request that the Service starts immediately and to acknowledge what this means for your right of withdrawal. You can withdraw with the "Withdraw from contract" option on the Subscription page in Settings, or by emailing playtheory@musiciangoods.com. If you withdraw after asking us to start immediately, we end your Pro access and refund what you paid minus a proportional amount for the days you already used. We refund within 14 days, using the payment method you used.

    Renewal and Cancellation

Subscriptions renew automatically until you cancel. You can cancel at any time on the Subscription page in Settings. A monthly plan renews each month; if you cancel it, you keep Pro until the end of the month you paid for and are not charged again. A quarterly or yearly plan runs for its first term; if you cancel during the first term, you keep Pro until the end of that term and are not charged again; after that first term it continues for an indefinite period, you can cancel it at any time with a notice period of at most one month, and we refund the part of the current payment that falls after the end of that notice period.

    Failed Payments

If a renewal payment fails, you keep Pro while our payment provider retries the payment, and the app shows you how to update your payment method. If the payment still fails after the retries, your subscription ends and your account continues on the free plan. Your progress is never deleted because of a failed payment.

    Price Changes

We may change our prices. A price change never applies to a period you have already paid for. We tell you at least 30 days before a new price applies to your subscription, and you may cancel before it takes effect.

    Acceptable Use

Do not misuse or disrupt the Service, try to access other people's accounts or data, get around paywalls, limits or security measures, copy or redistribute lessons or audio except as the Service allows, or use the Service to break the law. In the social features, do not harass, impersonate or spam other learners; you can remove or block anyone. We may suspend an account that seriously or repeatedly breaks these rules; where possible we warn you first and tell you why.

    Profiles and Social Features

Your username, avatar and learning totals (XP, lessons completed and streak) are visible to other signed-in learners. Only your friends also see your first name and more of your progress. Choose a username that does not contain your email address or other information you want to keep private. You can change your username and avatar in Settings.

    AI Tutor

The AI tutor answers questions about the lessons using an AI model. Its answers can be wrong or incomplete; use them as study help, not as professional advice. Daily message limits apply and are shown in the app. Do not share sensitive personal information in the chat.

    Intellectual Property

The Service and its content (lessons, texts, audio, graphics, software and the PlayTheory name and logo) belong to Excellence Online B.V. or its licensors. You may use the Service for your own learning. Anything original you create in the Service remains yours; you allow us to store and process it only to provide the Service to you.

    Quality of the Service

We do our best to keep the Service available, accurate and working as described, and the statutory rules on conformity of digital content and services apply to your subscription. Note detection by microphone or MIDI depends on your device and surroundings and may not always be perfect. We cannot promise a particular learning result.

    Liability

Our liability is limited to the amount you paid us in the 12 months before the event that caused the damage, and we are not liable for indirect damage such as lost profits or lost data. These limits do not apply to damage caused by our intent or gross negligence, or where the law does not allow such limits. Nothing in these Terms limits your statutory rights as a consumer.

    Ending the Contract

You can stop using the Service and delete your account at any time in Settings; deleting your account also cancels an active subscription. We may end or suspend your account if you seriously breach these Terms, or end the Service altogether with at least 30 days' notice; in that case we refund the unused part of any prepaid period.

    Changes to These Terms

We may change these Terms, for example when we add features or when the law changes. We tell you about important changes at least 30 days in advance by email or in the app. If you do not agree, you can cancel before the changes take effect; changes never apply retroactively to a period you have already paid for.

    Law and Disputes

Dutch law applies to these Terms. If you live in another EU/EEA country, you keep the protection of the mandatory consumer law of your country. Please contact us first so we can try to solve a complaint; we reply within 14 days. You may also bring a dispute before the competent court in the Netherlands or in your own country of residence.
